In Caso Tronox (The Old Kerr-McGee/Tronox Case: 'Securing Environmental Justice?' Tronox Inc., et al., and United States v. Anadarko Petroleum Corp., et al., Bankruptcy Adversary Proceeding No. 09-1198)

Abstract

On April 3, 2014 the United States Department of Justice announced the “$5.15 Billion Settlement of Litigation Against Subsidiaries of Anadarko Petroleum Corp. to Remedy Fraudulent Conveyance Designed to Evade Environmental Liabilities.” The Department described it as the largest environmental enforcement recovery ever by the Department of Justice. Here in addition to the corporations the litigation involved the EPA; the U.S. Fish & Wildlife Service and Bureau of Land Management of the U.S. Department of the Interior; the National Oceanic and Atmospheric Administration of the U.S. Department of Commerce; the U.S. Nuclear Regulatory Commission; the U.S. Forest Service of the U.S. Department of Agriculture; the U.S. Department of Defense and several state governments and the Navajo Nation. This brief note describes the proposed settlement and the actions leading up to it.
