Abstract
Whatever the outcome is of the 2008 presidential election in the United States, it is probable that the stance of the new administration regarding international treaties and climate change will be different from that of President Bush (Candidates Clinton, Obama, and McCain are all favorable to some federal involvement). And, independent of new leadership of federal officials, legal initiatives will continue to be numerous. In this article we review the status of controversies regarding global warming in federal courts, in the Congress, and in state courts, including those involving private litigation.
